Terms and Conditions

1. General
1.1 These general terms and conditions apply to all offers made by Stratizet.
The terms and conditions are accessible to everyone and are included on the Stratizet website. Upon request, we will provide you with a written copy.
1.2 By placing an order, you indicate that you agree to the delivery and payment terms and conditions. Stratizet reserves the right to change its delivery and/or payment conditions after the expiration of the term.
1.3 Unless otherwise agreed in writing, Stratizet does not recognize the general or specific conditions or provisions of third parties.
1.4 Stratizet guarantees that the delivered product complies with the agreement and meets the specifications stated in the offer.

2. Delivery
2.1 Delivery takes place as long as supplies last.
2.2 In the context of distance selling regulations, Stratizet will fulfill orders within 30 days at the latest. If this is not possible (due to the ordered item being out of stock or no longer available), or if there is a delay for other reasons, or if an order cannot be fulfilled or only partially fulfilled, the consumer will be notified within 1 month after placing the order. In such a case, the consumer has the right to cancel the order without any costs or notice of default.
2.3 Unless proven otherwise, Stratizet's obligation to deliver will be fulfilled once the goods delivered by Stratizet have been offered to the buyer. In the case of home delivery, the carrier's report, indicating refusal of acceptance, serves as full proof of the offer of delivery.
2.4 All timeframes mentioned on the website are indicative. Therefore, no rights can be derived from the mentioned timeframes.

3. Prices
3.1 Prices will not be increased during the validity period of the offer, unless legal measures make it necessary or if the manufacturer implements interim price increases.
3.2 All prices on the website are subject to printing and typesetting errors. No liability is accepted for the consequences of printing and typesetting errors.
3.3 All prices on the website are in Euros and include 9% or 21% VAT.

4. Cooling-off Period / Right of Withdrawal
4.1 If it concerns a consumer purchase, in accordance with the Distance Selling Act (Article 7:5 Dutch Civil Code), the buyer has the right to return (part of) the delivered goods within a period of 14 working days without stating a reason. This period starts on the day the ordered goods have been delivered. If the buyer does not return the delivered goods to Stratizet after this period has expired, the purchase is considered final. The buyer is obliged to notify Stratizet in writing within 14 working days after delivery before proceeding with the return. The buyer must prove that the goods have been returned on time, for example by providing proof of postage. The returned goods must be sent in their original packaging (including accessories and accompanying documentation) and in new condition. If the goods have been used, burdened, or damaged in any way, the right to cancel as described in this clause is void. Subject to what is stated in the previous sentence, Stratizet will ensure that the full purchase amount, including the calculated shipping costs, is refunded to the buyer within 30 days after receiving the returned shipment. The return shipment of the delivered goods is entirely at the expense and risk of the buyer.
4.2 The right of withdrawal does not apply to:
• services for which the execution, with the consent of the consumer, started before the 7-working-day period
• goods or services whose price is subject to fluctuations on the financial market that Stratizet has no influence on
• goods that are manufactured according to the consumer's specifications, for

example, custom-made products or products with a clear personal character
• goods or services that cannot be returned due to their nature, for example, for reasons of hygiene or that can spoil or age quickly
• audio and video recordings and computer software if the consumer has broken the seal
• the delivery of newspapers and magazines; for the services of betting and lotteries

5. Data Management
5.1 If you place an order with Stratizet, your data will be included in the customer database of Stratizet. Stratizet complies with the Dutch Personal Data Protection Act and will not provide your data to third parties. See our Privacy Policy.
5.2 Stratizet respects the privacy of users of the website and ensures confidential treatment of your personal data.
5.3 Stratizet may use a mailing list in some cases. Each mailing contains instructions on how to remove yourself from this list.

6. Warranty
6.1 Stratizet guarantees that the products it delivers meet the requirements of usability, reliability, and lifespan as intended by the parties to the purchase agreement, and therefore is responsible for the factory warranty of the product delivered to you.
6.2 The warranty period of Stratizet corresponds to the manufacturer's warranty period. However, Stratizet is never responsible for the ultimate suitability of the goods for each individual application by the buyer, nor for any advice regarding the use or application of the goods.
6.3 The buyer is obliged to immediately inspect the delivered goods upon receipt. If it appears that the delivered item is wrong, defective, or incomplete, the buyer must immediately report these defects in writing to Stratizet (before returning them to Stratizet). Any defects or incorrectly delivered goods must be reported to Stratizet in writing within a maximum of 14 days after delivery. The returned goods must be sent in their original packaging (including accessories and accompanying documentation) and in new condition. Use of the goods after establishing any defects, damage occurring after establishing defects, burdening, or resale after establishing defects, means that the buyer has accepted the goods and the right to complain and return the goods has lapsed.
6.4 If the buyer's complaints are found to be justified by Stratizet, Stratizet will, at its discretion, replace the delivered goods free of charge or reach a written agreement with the buyer on compensation, provided that the liability of Stratizet and thus the amount of the compensation is always limited to at most the invoice amount of the goods in question, or (at Stratizet's choice) to the maximum amount covered by Stratizet's liability insurance in the relevant case. Any liability of Stratizet for any other form of damage is excluded, including additional compensation in any form, compensation for indirect damage, consequential damage, or damage due to lost profits.
6.5 Stratizet is not liable for damage caused by intent or equivalent deliberate recklessness by non-managerial personnel.
6.6 This warranty does not apply if: A) and as long as the buyer is in default towards Stratizet; B) the buyer has repaired or processed the delivered goods themselves or had them repaired or processed by third parties; C) the delivered goods have been exposed to abnormal conditions or have been handled inappropriately or contrary to Stratizet's instructions and/or the instructions for use on the packaging; D) the defects are wholly or partially the result of regulations prescribed or to be prescribed by the government regarding the nature or quality of the materials used.

7. Offers
7.1 Offers are without obligation unless otherwise stated in the offer.
7.2 When a buyer accepts a non-binding offer, Stratizet reserves the right to revoke or deviate from the offer within 3 working days after receiving the acceptance.

.3 Verbal commitments by Stratizet are only binding after they have been confirmed explicitly and in writing.
7.4 Offers from Stratizet do not automatically apply to repeat orders.
7.5 Stratizet cannot be held to its offer if the buyer should have understood that the offer, or any part of it, contains an obvious mistake or error.
7.6 Additions, changes, and/or further agreements are only valid if agreed upon in writing.

8. Agreement
8.1 An agreement between Stratizet and a customer is established after an order has been assessed for feasibility by Stratizet.
8.2 Stratizet reserves the right to refuse orders or assignments without stating reasons or to accept them only on the condition that the shipment is made under cash-on-delivery or after prepayment.

9. Images and Specifications
9.1 All images, photos, drawings, etc., including data regarding weights, dimensions, colors, label images, etc. on the Stratizet website are approximate, indicative, and cannot be the basis for any compensation or dissolution of the agreement.

10. Force Majeure
10.1 Stratizet is not liable if and to the extent that its obligations cannot be fulfilled due to force majeure.
10.2 Force majeure is understood to mean any foreign cause, as well as any circumstance that is reasonably not at Stratizet's risk. Delays or breaches of contract by our suppliers, disruptions in the Internet, disruptions in electricity, disruptions in email traffic, disruptions or changes in technology provided by third parties, transport difficulties, strikes, government measures, delays in supply, negligence of suppliers and/or manufacturers of Stratizet, as well as its assistants, illness of personnel, defects in auxiliary or transport equipment, are explicitly regarded as force majeure.
10.3 In the event of force majeure, Stratizet has the right to suspend its obligations and is also entitled to dissolve the agreement in whole or in part, or to demand that the content of the agreement be amended so that execution remains possible. In no case is Stratizet obliged to pay any penalty or compensation.
10.4 If Stratizet has already partially fulfilled its obligations upon the occurrence of force majeure, or can only partially fulfill its obligations, it is entitled to separately invoice the already delivered or deliverable part, and the buyer is obliged to pay this invoice as if it concerned a separate agreement. However, this does not apply if the already delivered or deliverable part has no independent value.

11. Liability
11.1 Stratizet is not liable for damage caused to vehicles or other objects as a result of improper use of the products. Before use, read the instructions on the packaging and/or consult our website.

12. Retention of Title
12.1 Ownership of all goods sold and delivered by Stratizet to the buyer remains with Stratizet until the buyer has fully paid the amounts owed to Stratizet under the agreement or previous or subsequent similar agreements, until the buyer has fully paid for the work performed or yet to be performed under these or similar agreements, and until the buyer has fully paid the amounts owed to Stratizet due to a breach of contract, including claims for penalties, interest, and costs, as referred to in Article 3:92 of the Dutch Civil Code.
12.2 Goods delivered by Stratizet that fall under the retention of title may only be resold in the context of normal business operations and may never be used as a means of payment.
12.3 The buyer is not authorized to pledge the goods subject to retention of title or to encumber them in any other way.
12.4 The buyer already now unconditionally and irrevocably grants permission to Stratiz

et or a third party to be appointed by Stratizet to enter all those places where Stratizet's properties will be located at that time and to take those goods there.
12.5 If third parties seize the goods delivered subject to retention of title or wish to establish or enforce rights on them, the buyer is obliged to inform Stratizet of this as soon as can be reasonably expected.
12.6 The buyer undertakes to insure the goods delivered subject to retention of title and to keep them insured against fire, explosion, and water damage, as well as theft, and to provide Stratizet with the insurance policy for inspection upon first request.

13. Applicable Law/Jurisdiction
13.1 Dutch law applies to all agreements.
13.2 The competent court within the district of Leeuwarden has jurisdiction over any disputes arising from an agreement between Stratizet and the buyer that cannot be resolved through mutual consultation, unless Stratizet prefers to submit the dispute to the competent court of the buyer's place of residence, without prejudice to those disputes that fall under the jurisdiction of the subdistrict court.

14. Laws and Regulations
14.1 To purchase a paintball marker, you must be 18 years of age or older as a buyer. In addition, Stratizet (GoPaintball.nl) is legally obligated to retain your purchase and personal data, including your identification document number and type, for 7 years. To verify this, we will ask you to send a copy of your identification document to us after the purchase. You may hide your photo and social security number (BSN) when sending the email. The email you receive after your purchase will provide instructions on how to do this securely and with limited information. We will always adhere to the applicable privacy laws and handle your data with care and discretion.
